This day came the grand jury into open court and
presented a bill of indictment against Oliver Conn for
an assault with intent to kill and murder one Mathew
D. Wade, a true bill and returned to consider other
presentations. (January Term 1832 Franklin County

This day Rollo P. Raines and Abram Shook, the
defendants securities for his appearance surrendered
the said principal in open court who was thereupon
ordered into custody of the sheriff. (July Term 1832

Indictment for assault with intent to kill State vs.
Oliver Conn
This day came John B. Forrester Esq. the Attorney
General who prosecutes for the state in their behalf
as well as the defendant in his proper person and the
said defendant having heard the bill of indictment
read says he is not guilty in manner and form as
charged in the bill of indictment and for the trial
puts himself upon the county and the said Attorney
General does the like. Where upon came a jury to wit,
William Crain, Charles Gillespie, John P. Martin,
Chester Oldham, Isham Warmack, Thomas M. Moses, Asa D.
Oakley, Joseph Nuckles, Thomas South, Sampson McLane,
Thomas Williams, Amos Franklin, who being elected,
tried, and sworn well and truly to try the case of
traverse, joined upon their oath to say they find the
defendant not guilty in manner and form as charged in
the bill of indictment. It is therefore considered by
the court that the defendant go hence without delay
and excuses such cause to him in his behalf and
expended as the county can find proper to allow.

Deed of Trust to Abram Shook
This indenture made & entered into this 17th day of
March 1834 between Oliver Conn and Abram Shook both of
the County of Franklin and State of Tennessee.
Witnesseth that the said Oliver Conn for and in
Consideration of the sum of fifty nine dollars the
receipt of which is hereby acknowledged hath this day
bargained and sold and by these presents doth bargain
sell and convey unto the said Abram Shook one sorrell
mare about ten years old now in the possession of sd
Conn, also the crop to be raised the present year on
ten acres of corn and five acres of cotton. To have
and to hold to him the sd Shook his heirs and assigns
forever the right and title of which the sd Conn doth
by these presents warrant and forever defend against
himself his heirs and assigns and the claims of all
other persons. In trust never the less for that
whereas the said Oliver Conn stands justly indebted to
Porter Keith in the sum of fifty nine dollars due by
note on the 25th day of October 1833 and to secure the
payment of said note the sd Conn hath executed this
deed of trust. Now therefore if the said Oliver Conn
shall well and truly pay and satisfy sd debt by the
25th of October 1834 then this conveyance to become
void and of no effect but if he should fail or refuse
to pay the same or any part thereof by the 25 of
October next it shall become the duty of said Trustee
to proceed to sell sd mare and the crop which shall be
then made to the highest bidder for cash after having
given ten days notice in writing. Sale to take place
on the premises now occupied by sd Conn and the
proceeds to be paid to said Keith in discharge of said
debt and the overplus if any (after paying for the
drawing this deed of trust and the expenses of Sale)
to be paid to said Conn or his assigns. And be it
furthermore understood in Trust that the said Oliver
Conn is to have the use and possession of said
property until sd 25th of October next. In testimony
whereof the said Conn and Shook have hereunto set
their hands and seals this the day and year first
above written.

overseer of the road from David Hunt's to Salem of the
2nd class and that he keep the same in good repair
according to the law and that William Larkins Esq.

Whereas Oliver Conn is indebted to Patrick and Co. in
the sum of one hundred and fourteen dollars and thirty
two cents by note dated the day of December 1838 and
due the 25th day of December 1838 and being desirous
to secure the payment of the same is willing to
execute a deed of trust to James Robinson as Trustee
for that purpose. Now this indenture is made and
entered into this 15th day of December 1838 between
the said Oliver Conn of the one part and James
Robinson of the other part and all of the County of
Franklin and State of Tennessee. Witnesseth that the
said Oliver Conn for and in consideration of the debt
aforesaid and also the sum of one dollar in hand paid
by the said James Robinson the receipt whereof he doth
hereby acknowledge has this day bargained and sold and
doth by these presents bargain and sell unto the said
James Robinson the following property to wit, one gray
mare about nine years old, one Dum (??) mare colt two
years old next spring, one black cow and calf, one
pot, one skillet, one oven and one saddle and bridle
to have and to hold the above described property, to
the said James Robinson forever. Subject to the
following trusts to wit that should the said Oliver
Conn on or before the 1st day of April 1839 pays the
debts aforesaid together with all interest costs and
manages to pay the costs of this deed of trust then
the said James Robinson is to reconvey the property
hereby conveyed to the said Oliver Conn, but should
payment not be made as above the said James Robinson
is hereby authorized to sell the property to the
highest bidder for cash after giving five days notice
to posting of an advertisement in Salem, Tn. The
testimony whereof the said Oliver Conn and James
Robinson have hereunto set their hands and seals, the
day and date aforesaid.

Note:
Salem community was in the south east portion of the
county. It had good merchants and for many years Mrs.
Cowan's hotel was considered one of the best in the
country. On the 7th of March 1873, the town was
nearly all destroyed by fire. Mrs. Cowan's hotel,
some dwellings and every business house in the village
were consumed. The loss was estimated at $34,000.
The town has never been rebuilt. The road mentioned
may have been the Old Bean's Creek Road which is off
highway 64.
Salem was the first center of trade in the county.
Long before 1840 Salem was a noted cotton market. The
merchants exchanged goods for cotton and then shipped
the cotton by water to New Orleans, using the Elk
River in its flood stage to reach the Tennessee River,
on to the Ohio River and then down to New Orleans.

Tennessee) John R. Patrick was listed as one of the
early merchants of Salem. (Goodspeed) The cotton
sold for 1 1/4 to 2 1/4 cents per pound. The
merchants would take the cotton to New Orleans and
then walk back through the Chickasaw and Choctaw
Indian Nations. (Goodspeed) Beginning in the 1840
period, there were quite noted carriage & coach
manufacturing concerns in Winchester. Among these
were Thomas Logan and Porter & Co. Logan and Hutchins
was located on a lot just behind the present
Cumberland Presbyterian Church and Porter Co. on
Jefferson Street at the place of Mr. C. C. Tucker's

assault.

Indictment for assault with intent to murder
This day came Joseph M. Carter Esq. the Attorney
General who prosecutes for the state in this behalf as
well as the defendant in his proper person and on
motion of the Attorney General, this cause is
continued until the next term of this court.
Whereupon the said defendant, James P. Keith, and
Hezekiah Faris came into court and acknowledged
themselves indebted to the state of Tennessee in the
following sums, to wit the said defendant in the sum
of $250, and the said Keith and Faris in the sum of
$125 each to be levied of their respective goods and
chattel lands and tenements to the use of said State
but to be void on condition that Oliver J. Conn doeth
make his personal appearance here before the judge of
our next Circuit Court on the 1st Wednesday after the
third Monday in March next to answer said charges and
not depart court without leave.

State vs. Oliver Conn assault with intent to kill
The trial finally takes place. The jury called
consists of John Handy, Wm. R. Francis, John C.
Montgomery, Jeptha U. Horton, Abram Shook, James C.
Handy, Wm. P. Martin, James Wagner, A. J. Aliceman,
Stephen Smith, James Byron, and John Nugent. They
find Oliver guilty and fine him $7.50 plus cost of
prosecution. James P. Keith came to Court and
acknowledged himself the defendant's security. The
victim was Isaac Stephens.
1850
Franklin County Census
Oliver's wife is named Francis and is in this census
age 41 and says she was born in Tennessee. Oliver is
42 (b:1807) and states that he was born in Virginia.
His occupation is listed as farmer although in the
column "Value of Real Estate owned" is recorded
"none". With Oliver and Francis are the following
children: Elizabeth age 24, Sarah Ann age 18, Jane
age 16, James Oliver age 14, Francis E. age 10, and
Letty age 21.
1860
Franklin County Census Oliver is 53 (born 1807) and
still claims to have been born in Virginia. Francis
is 52 and states she was born in North Carolina.
Oliver is now a wheelwright. Jane age 24 born Tn is
still in the home. Oliver has changed occupations from
farmer to wheelwright and has lost five children to
either death or marriage. A check of the Franklin
County Marriage records shows the following marriages:

From a list of property and effects belonging to the
estate of Pierce B. Anderson, "One order on Dr.
Kincaid drawn by Oliver Con dates Aug 1856 for 2.85".
This may indicate that Oliver was ill or some member
of his family. It also indicates that he didn't have
the $2.85 to pay the bill.

Census Franklin County This shows Oliver J. Conn age
67 (b:1803) a wagonmaker living in Decherd with value
of personal estate $100. His wife Francis is age 66
and states that she was born in South Carolina.
Living in the same house is Isaac Mahaffey and Frances
E. and their children (six in number) along with
Sallie Howard, a black female house servant age 24.

Pauper Support.
A majority of Magistrates being present and voting for
the same. Ordered by the Court that Oliver J. Conn
and wife be allowed $50.00 for their years support as
paupers, that a certificate issue to Jno. B. March as
receiver to draw the same quarterly out of the County
Treasury and appropriate to their use. (Franklin

Notes: Oliver's oldest daughter in the 1850 census stated that she
was born in Alabama. This is the only clue to the
